LITTLE ROCK, AR — Two more Arkansas Supreme Court justices have recused themselves from a hearing on the case challenging the state’s same-sex marriage ban.
Chief Justice Jim Hannah and Justice Paul Danielson will not be involved in the new case ordered by the court last week to re-hear arguments.
The court first heard the case last November after a lower court struck down the ban months earlier.
A new round of arguments was ordered because new justices have been elected since the previous hearing.
Justice Danielson says by doing so, the court “manufactured a case” where no controversy exists.
Regardless of the state court’s decision, a U.S. Supreme Court decision on Same-Sex marriage is expected this summer.
Their ruling will be the final determination of whether states can ban it.
